Cash or letter of financial pre-qualification required. 20% non-refundable down payment day of auction. Balance will be due on or before October 12, 2017. This property will be sold in “as is” condition and will be transferred via Quit Claim Deed. Buyer(s) will be asked to enter into a written agreement specifying these terms the day of the auction. This property is being offered as a cash transaction and not subject to any financing contingencies. Sale is subject to the owner’s confirmation. Seller reserves the right to reject, accept, or negotiate the final bid. This transaction will become binding only on a written execution of a contract between both buyers and sellers. Disclaimer: Please see “Terms Section” of online sale bill. Beyer Auction & Realty will be the closing agent, representing the sellers in this transaction.
Beyer Auction & Realty has put forth every effort in preparing the catalog to accurately describe each item. Printed or verbal statements made by staff are matters of opinion, and are made in good faith. All items are sold ‘As Is, Where Is.’ Buyers are responsible for conducting their own inspection during open house/inspection periods, and no allowance will be made for inadvertent errors in cataloging, authenticity, or imperfections not specifically noted.
All sales are final ~ a bid is a legally binding contract between purchaser and Beyer Auction & Realty. The auction company reserves the right to reject any and all bids for any reason.
All accounts must be settled by the end of the pick-up day. Payment must be made with Cash, Valid check, VISA or Master Card, Cashier's check, Money order, or Wired funds. A 3% convenience fee will be assessed to credit card purchases.
All bidders must provide their name, address, daytime phone number, and email address at which they can be contacted, to insure adequate communication between Beyer Auction & Realty and their purchasers throughout any transaction.
The auctioneer has the sole discretion to advance and/or reject any bids, should it in his estimation prove injurious to the auction. The auctioneer shall be the final judge in any bidding disputes, and has final authority to name a bidder as the final purchaser. The auctioneer or auction company shall not be held responsible for any 'missed' or unseen bids.
Beyer Auction & Realty reserves the right to alter this agreement at any time. This will take place by updating this site. Please check back and review auction terms often, as every time you use this site you are agreeing to the terms as they are written at that time.
Beyer Auction & Realty reserves the right to refuse service to any person, or to cancel any auction at any time for any reason.
The purchaser agrees to pay all reasonable attorney fees and costs incurred by Beyer Auction & Realty in the collection of funds owed. The purchaser also agrees that a fee of 2% per month be added to any unpaid balance due the auction company, as well as any other costs or losses incurred due to the purchasers failure to adhere to these terms. Any debt collection or dispute proceedings will be settled by arbitration in Sioux County, Iowa.
INFORMATION OF INTEREST TO BIDDERS
When bidder places a max bid, the current bid price doesn't automatically go to the max bid. When another bidder increases the current price, the computer will automatically increase bid in the increments specified, reaching your max bid only by ongoing bidding activity.
This auction has what is called an “auto-extend” feature, meaning the auction will not close until all bidding parties are satisfied. If any bids are placed within the last 5 minutes of the auction, the bid on lot(s) will extend an additional 5 minutes. The bidding will extend in 5 minute increments from the time the last bid is placed until there are no more bids, and the lot sits idle for 5 minutes. The auction company may, at their discretion, adjust the auto-extend time increment.
BIDDER RESPONSIBILITIES INCLUDE, BUT ARE NOT LIMITED, TO:
1. Bidders agree to keep their username and password confidential as they are responsible for ANY and ALL activity involving their account.
2. When using the web site, bidders must obey any and all local state and federal laws. Violations will result in termination of web site use privileges.
3. Auction company employees and/or auction company may bid on auction items.
